FOIA Requests

How to Submit a Freedom of Information (“FOIA”) Request:

To access information from the Illinois Department of the Lottery (the “Illinois Lottery”), please submit a written request by means of fax, the US mail or special carrier, or email to the Freedom of Information Officer. A written request will ensure proper compliance with the requirements of the Act.

The Illinois Lottery requests that the FOIA Request identify if it is for a Commercial Purpose. The Illinois Lottery does not require that FOIA request be submitted in any particular form. However, we strongly prefer that the FOIA Request, at a minimum, includes the phrase "Freedom of Information Act” or "FOIA”; contains a description of the types of records sought; and contains contact information so we may follow up to clarify or narrow a request if necessary. Further, although we will take written requests via mail, fax or hand delivery, we strongly prefer you submit your written request via email. If you are requesting a waiver of any fees for copying the documents, you must attach a statement of the purpose of the request and whether the principal purpose of the request is to access or disseminate information regarding the health, safety and welfare or legal rights of the general public. 5 ILCS 140/6(c).

Commercial Purpose:

It is a violation of this Act for a person to knowingly obtain a public record for a commercial purpose without disclosing that it is for a commercial purpose, if requested to do so by the public body. 5 ILCS 140/3.1(c), "Commercial Purpose" means the use of any part of a public record or records, or information derived from public records, in any form for sale, resale, or solicitation or advertisement for sales or services. For purposes of this definition, requests made by news media and non-profit, scientific, or academic organizations shall not be considered to be made for a "Commercial Purpose" when the principal purpose of the request is (i) to access and disseminate information concerning news and current or passing events, (ii) for articles of opinion or features of interest to the public, or (iii) for the purpose of academic, scientific, or public research or education. 5 ILCS 140/2(c-10).
